Senate Bill No. 484--A Bill to repeal §49-5-21 of the Code of West Virginia, 1931, as amended; to repeal §49-6-5a of said code; to amend and reenact §49-1-3 of said code; to amend and reenact §49-5-13 of said code; to amend and reenact §49-5D-3 and §49-5D-3a of said code; to amend said code by adding thereto two new sections, designated §49-5D-3b and §49-5D-3c; to amend and reenact §49-6-2, §49-6-3, §49-6-5, §49-6-6, §49-6-8 and §49-6-12 of said code; to amend said code by adding thereto a new section, designated §49-6-9a; to amend and reenact §49-6D-3 of said code; to amend and reenact §49-7-1 of said code; and to amend said code by adding thereto a new section, designated §49-7-36, all relating to child welfare; defining “court appointed special advocate program”; providing when a juvenile is ordered into out-of-state placement, the reasons why the juvenile was not placed in-state be included in the court order; providing a process for multidisciplinary treatment planning in cases involving child abuse and neglect; providing a process for multidisciplinary treatment planning in cases involving status offense or delinquency; increasing the continuing education hours required for attorneys appointed in child abuse and neglect cases; providing that reasonable efforts to preserve the family are not required when a person is required by state or federal law to register with a sex offender registry; providing that the court may modify a dispositional order when it finds a material change of circumstances has occurred and such modification is in the child’s best interests; clarifying that the circuit court of origin has exclusive jurisdiction over placement of a child in a child abuse and neglect case; providing a process for permanency hearings and permanent placement reviews; authorizing family court to order a child be taken into emergency custody under certain circumstances and providing a process for such; providing that any combination of improvement periods cannot cause a child to be in foster care more than fifteen months of the most recent twenty-two months unless the court finds that it is in the child’s best interests; providing guidelines for unified child and family case plans; confidentiality of records; and requiring a quarterly status review hearing and yearly permanency hearings for transitioning adults.

Senate Bill No. 487--A Bill to amend and reenact §11-13A-20a of the Code of West Virginia, 1931, as amended, relating to the distribution of coalbed methane gas severance tax; establishing the Coalbed Methane Gas Distribution Fund in the State Treasurer’s Office; making technical changes to correct subdivision references; correcting the omission of the term “county economic development corporation”; authorizing the Tax Commissioner to deposit coalbed methane severance tax moneys into the Coalbed Methane Gas Distribution Fund; directing the State Treasurer to distribute coalbed methane severance tax moneys to counties; authorizing distribution of moneys to the lead economic development authority or corporation for the county and designation thereof; authorizing distribution by the State Treasurer of accumulated moneys from fiscal years 2009, 2010, 2011 and 2012 to the lead economic development authority or corporation for the county and designation thereof; specifying the permissible uses of Coalbed Methane Gas Distribution Fund moneys received by county economic development authorities and corporations; eliminating the requirement of Development Office approval for use of funds; and creating a reporting mechanism for accounting and use of Coalbed Methane Gas Distribution Fund moneys.

Senate Bill No. 489--A Bill to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §9-2-11a, relating to preventing taxpayer subsidization of health insurance covering elective abortions; prohibiting all qualified health plans offered through a state exchange from including abortion coverage except to prevent the death of the mother; preventing all other health plans, including health insurance contracts, plans or policies, offered outside of the exchange, but within the state, from providing coverage for elective abortions except by optional separate supplemental coverage for abortion; and providing a severability clause.

Senate Bill No. 492--A Bill to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §21-11-21; and to amend said code by adding thereto a new section, designated §31-17-21, all relating to requiring residential construction projects to be bonded; setting forth a contractor’s responsibilities; and requiring a lender making a loan for residential construction services to be financially responsible for payment to the contractor and any subcontractors who provide those services and to suppliers of materials used in the construction.

Senate Resolution No. 21--Expressing support for improvement in the collection, processing and consumption of recyclable materials throughout the State of West Virginia.
Whereas, Maximizing the recycling economy in the State of West Virginia will create and sustain additional well-paying jobs, further stimulate the economy of the state, save energy, and conserve valuable natural resources; and
Whereas, Municipal recycling rates in the United States have steadily increased from 6.6 percent in 1970 to 34 percent in 2010; and
Whereas, Forty-six states, including the State of West Virginia, have laws promoting the recycling of materials that would otherwise be sent to a landfill; and
Whereas, Recycling stimulates the economy and plays an integral role in sustaining manufacturing in the United States; and
Whereas, In 2010, the United States recycling industry collected, processed, and consumed over 130 million metric tons of recyclable material, valued at $77 billion; and
Whereas, In 2010, the recycling industry in the United States sold over 44 million metric tons of commodity grade materials, valued at $30 billion, to over 154 countries; and
Whereas, Using recycled materials in place of raw materials can result in energy savings of ninety-two percent for aluminum cans, eighty-seven percent for mixed plastics, sixty-three percent for steel cans, forty-five percent for recycled newspaper, and thirty-four percent for recycled glass; and
Whereas, A 2011 study titled “More Jobs, Less Pollution: Growing the Recycling Economy in the U. S.,” prepared by Tellus Institute, concluded that nearly 1.5 million more recycling jobs would be created if the national recycling rate reached seventy-five percent by 2030. The report also concluded that higher recycling rates produce, in general, 10 to 20 times more jobs than land filling; therefore, be it
Resolved by the Senate:
That the Senate expresses support for improvement in the collection, processing and consumption of recyclable materials throughout the State of West Virginia; and, be it
Further Resolved, That the Senate supports improvement in the collection, processing and consumption of recyclable material throughout the State of West Virginia in order to create well-paying jobs, foster innovation and investment in the state’s recycling infrastructure, and stimulate the economy of the state; and, be it
Further Resolved, That the Senate expresses support for strengthening the manufacturing base in the State of West Virginia in order to rebuild the domestic economy, which will increase the supply, demand, and consumption of recyclable and recycled materials in the State of West Virginia; and, be it
Further Resolved, That the Senate expresses support to the West Virginia Public Service Commission and the West Virginia Department of Environmental Protection to permit resource recovery facilities in the state as a means to increase the collection of recyclable materials and the utilization of solid waste as a resource rather than land filling; and, be it
Further Resolved, That the Senate expresses support for policies in the state that promote recycling of materials and the use of solid waste as a resource rather than sent to a landfill; and, be it
Further Resolved, That the Senate expresses support for policies in the State of West Virginia that recognize and promote recyclable materials as essential economic commodities, rather than wastes to be land filled; and, be it
Further Resolved, That the Senate expresses support for new technologies to more efficiently and effectively recycle materials; and, be it
Further Resolved, That the Senate recognizes that the recycling industry in the State of West Virginia is a manufacturing industry that is critical to the future of the State of West Virginia; and, be it
Further Resolved, That the Senate expresses support for the participation of households, businesses, waste haulers and governmental entities in the State of West Virginia in recycling and resource recovery programs, where available.
